Del HC: Can Refer to Arbitration Dispute Regarding Use of TM by Partner for His Sole Proprietorship - (13 Jan 2023)

ARBITRATION

Delhi High Court while observing that disputes relating to subordinate rights in personam arising from rights in rem are arbitrable has held that dispute whether a partner can use the partnership firm’s trademark for his own sole proprietorship concern, can be referred to arbitration.
