Implementation plan - New Regulatory Framework 2020- (Telecom Regulatory Authority of India) (01 Sep 2022)

1. The Telecom Regulatory Authority of India (hereinafter referred to as the "Authority"), vide letter of even number dated 1st June 2022, directed all the broadcasters to report to the Authority, any change in name, nature, language, Maximum Retail Price (MRP) per month of channels, and composition and MRP of bouquets, as per the New Regulatory Framework 2020, by 31st August 2022. Further, it directed all the Distribution Platform Operators (DPOs) to report to the Authority, Distributor Retail Price (DRP) of pay channels and bouquets of pay channels and composition of bouquets of pay and free-to-air (FTA) channels, as per the New Regulatory Framework 2020, by 30th September 2022. Furthermore, it directed all the distributors to ensure that services to the subscribers, with effect from 30th November 2022, are provided as per the bouquets or channels opted by them.

2. In order to address the issues as identified by the committee of stakeholders for smooth implementation of new regulatory framework 2020, the Authority released a consultation paper no. 05/2022 dated the 07th May 2022 on "Issues related to New Regulatory Framework for Broadcasting and Cable services". The last date of receiving comments on the issues raised in the said Consultation Paper from the stakeholders was fixed as 30th May 2022 and counter-comments as 06th June 2022.

However, on request received from the stakeholders, the last date for submission of comments & counter-comments on the above-mentioned consultation paper was further extended upto 06th June 2022 & 13th June 2022 respectively. Comments & counter-comments received from the stakeholders on the above-mentioned consultation paper were uploaded on the TRAI's website.

4. Open House Discussion (OHD) on the above-mentioned consultation paper, which was scheduled to be held on 21st July 2022, has now been scheduled on 8th September 2022.

5. Further, several representations have also been received from the stakeholders requesting for extension of time limit for implementation of New Regulatory Framework 2020.

6. Keeping in view the ongoing consultation process & requests received from the stakeholders for extension of timelines for implementation of New Regulatory Framework 2020, it has been decided to extend the deadlines as provided under the said letter dated 1st June 2022.

7. Now, therefore, all the broadcasters shall report to the Authority, any change in name, nature, language, MRP per month of channels, and composition and MRP of bouquets of channels as per the New Regulatory Framework 2020, by 30th November 2022, and simultaneously publish such information on their websites. The broadcasters who have already submitted their RIOs in compliance of the New Regulatory Framework 2020 may also revise their RIOs by 30th November 2022.

8. Further, all DPOs shall report to the Authority, DRP of pay channels and bouquets of pay channels, and composition of bouquets of pay and FTA channels, as per the New Regulatory Framework 2020 by 31st December 2022, and simultaneously publish such information on their websites. DPOs who have already submitted their RIOs in compliance of the New Regulatory Framework 2020 may also revise their RIOs by 31st December 2022.

9. Furthermore, all the distributors of television channels shall ensure that services to the subscribers, with effect from 28th February 2023, are provided as per the bouquets or channels opted by them.

10. This issues with the approval of the competent authority.
